Court in Curacao bars Kortijn from linking its brand to LOVERS

WILLEMSTAD — Kortijn Ice Company has 14 days to stop using the LOVERS brand and marketing that creates an association with former Lovers products.

The court ruled that phrases such as “same LOVE”, “made with LOVE” and “LOVE ICE”, as well as certain uses of a heart symbol, may no longer be used when they evoke the LOVERS brand. Violations carry a penalty of 5,000 guilders per day, up to 500,000 guilders.

The case is part of a wider dispute over the LOVERS trademark following the company’s bankruptcy and the sale of its assets to Kortijn.

The court has not yet decided who ultimately owns the LOVERS trademark. That issue remains before a court in the United States.
